ARTICLE 1: Definitions

In these general terms and conditions, the following terms are used with the following meaning, unless expressly stated otherwise:

1.1 General Terms and Conditions
These General Terms and Conditions apply to the legal relationship between the Customer and Shapetape. The distance purchase of Shapetape Articles implies familiarity with and acceptance of these terms and conditions.

1.2 Account
An account created by the Customer via the website of shapetape.nl.

1.3 Order
An order for one or more products placed by the Customer via the webshop. Business customers can also order via email or telephone.

1.4 Articles
The products that Shapetape sells via the webshop.

1.5 Customer
The natural or legal person who enters into an agreement with Shapetape.

1.6 Agreement
The (distance) purchase agreement between the Customer and Shapetape.

1.7 Parties
Shapetape and the Client jointly.

1.8 Return Policy
Shapetape's policy regarding returns.

1.9 cooling-off period
The period within which the Customer may exercise the right of withdrawal.

1.10 Intellectual property
All intellectual property rights of Shapetape, including copyright, design rights, and trademark rights.

1.11 Personal data
All data relating to an identified or identifiable natural person.

1.12 Webshop
The online shop on the shapetape.nl website.

1.13 Website
The website of Shapetape (www.shapetape.nl)

1.14 Business Customer(s)
Customers acting in the exercise of a profession or business.

1.15 Force majeur
Any circumstance beyond the control of Shapetape that prevents the performance of the agreement.

1.16 Non-attributable shortcoming
Including war, strikes, malfunctions, transport problems, or shortcomings of third parties.

1.17 Compani BV (Shapetape)
Registered with the Chamber of Commerce under number 97662968.

ARTICLE 2: Agreement & Applicability

2.1 These general terms and conditions apply to all offers, agreements, and services of Shapetape.

2.2 The terms and conditions are made available electronically and can always be consulted at shapetape.nl. They will be sent free of charge upon request. The Customer's general terms and conditions are expressly rejected.

2.3 Deviations are only valid if agreed upon in writing.

2.4 In the event of contradictions, the provision of the agreement shall prevail.

2.5 If a provision is invalid, the remaining provisions shall remain in force.

2.6 Business customers also receive these terms and conditions by email.

2.7 Shapetape is not bound by obvious errors, such as incorrect prices.

ARTICLE 3: Agreement, ordering process & account

3.1 Offers are without obligation.

3.2 The agreement is concluded as soon as the Customer accepts the offer and completes the order.

3.3 The Customer is obliged to provide accurate and up-to-date information.

3.4 The Customer consents to the processing of personal data in accordance with the privacy statement on shapetape.nl.

3.5 After placing an order, the Customer receives a confirmation and later a shipping confirmation with track & trace.

3.6 After placing the order, it can no longer be changed.

3.7 Typographical and spelling errors can be corrected by Shapetape.

ARTICLE 4: Price & payment

4.1 All prices include VAT.

4.2 Payment is made in advance via iDeal, credit card, or PayPal.

4.3 Shipping costs will be visible in the shopping cart.

4.4 The Customer waives the right to set off.

ARTICLE 5: Delivery

5.1 Delivery takes place at the specified address.

5.2 Delivery times depend on carriers and are not guaranteed.

5.3 Additional costs may apply to the Customer for delivery outside the EU.

5.4 Ownership transfers upon full payment.

ARTICLE 6: Return policy & right of withdrawal

6.1 Consumers have a cooling-off period of 30 days.

6.2 Returns must be shipped within 30 days of registration.

6.3 The refund will be issued upon receipt of the return.

6.4 In the event of misuse or damage, the right to a refund lapses.

ARTICLE 7: Quality of products

7.1 The statutory warranty applies.

7.2 In the event of defects, the product will be replaced or reimbursed.

7.3 Complaints do not suspend payment obligations.

ARTICLE 8: Privacy

8.1 Shapetape processes personal data carefully and securely.

8.2 Processing takes place exclusively for the execution of the agreement.

8.3 The GDPR applies.

8.4 Data is not processed outside the Netherlands.

ARTICLE 9: Liability

9.1 Liability is limited to direct damage.

9.2 Indirect damage is excluded.

9.3 Liability only arises after written notification.

9.4 Claims expire after 12 months.

ARTICLE 10: Complaints

10.1 Shapetape strives for optimal service and welcomes feedback. For questions or complaints, please contact us via info@shapetape.nl.

ARTICLE 11: Force Majeure

11.1 In the event of force majeure, Shapetape may terminate the agreement.

11.2 This applies when execution is not possible within 14 days.

11.3 Obligations are temporarily suspended.

ARTICLE 12: Intellectual property

12.1 All rights remain the property of Shapetape.

12.2 Use or copying without permission is prohibited.

12.3 Products may not be provided to third parties.

12.4 Indications of rights may not be altered.

ARTICLE 13: Final provisions

13.1 Invalid provisions do not affect the rest.

13.2 Disputes shall first be resolved through consultation.

13.3 Otherwise, the competent court shall decide.

13.4 These terms and conditions are governed by Dutch law.

13.5 The Vienna Sales Convention is excluded.

13.6 Shapetape may amend these terms and conditions.
