In these General Terms and Conditions, the following terms have the meanings set out below, unless expressly stated otherwise:

These General Terms and Conditions apply to the legal relationship between the customer and Shapetape. The distance purchase of items from Shapetape requires knowledge and acceptance of these terms and conditions.
1.2 Account
An account created by the customer through Shapetape.de’s website.
1.3 Order
An order for one or more products placed by the customer through the webshop. Business customers may also place orders by email or telephone.
1.4 Items
The products Shapetape sells through the webshop.
1.5 Customer
The natural person or legal entity entering into a contract with Shapetape.
1.6 Contract
The distance sales contract between the customer and Shapetape.
1.7 Parties
Shapetape and the customer jointly.
1.8 Return Policy
The return conditions applied by Shapetape.
1.9 Withdrawal Period
The period during which the customer may exercise their right of withdrawal.
1.10 Intellectual Property
All of Shapetape’s rights, including copyright, trademark, and design rights.
1.11 Personal Data
All information about an identified or identifiable person.
1.12 Webshop
The online shop at www.shapetape.de
1.13 Website
Shapetape’s website (www.shapetape.de)
1.14 Business customer(s)
Customers acting in the course of their commercial or professional activities.
1.15 Force majeure
Circumstances beyond Shapetape's control that prevent performance of the contract.
1.16 Non-attributable failure to perform
For example, war, strikes, system failures, transport problems, or omissions by third parties.

Registered with the Chamber of Commerce under number 97662968.
2.1 These General Terms and Conditions apply to all offers, contracts, and services of Shapetape.
2.2 The terms are provided electronically and can be viewed on the website at any time. They will be sent free of charge upon request. The customer's purchasing conditions are expressly excluded.
2.3 Deviations are valid only if agreed in writing.
2.4 In the event of inconsistencies, the provision in the contract shall prevail.
2.5 If individual provisions are invalid, the remaining provisions shall remain valid.
2.6 Business customers will also receive these terms by email.
2.7 Shapetape is not bound by obvious errors (e.g., incorrect prices).
3.1 Offers are non-binding.
3.2 The contract is concluded as soon as the customer accepts the offer and completes the order.
3.3 The customer is required to provide accurate and up-to-date information.
3.4 The customer agrees to the processing of their data in accordance with the privacy policy on the Shapetape.de website.
3.5 After placing the order, the customer receives an order confirmation and, later, a shipping confirmation with Track & Trace.
3.6 No changes are possible after the order has been placed.
3.7 Shapetape may correct typographical or spelling errors.
4.1 All prices include VAT.
4.2 Payment is made in advance via iDeal, credit card, or PayPal.
4.3 Shipping costs are displayed in the shopping cart.
4.4 The customer expressly waives the right to set off claims or exercise a right of retention.
5.1 Delivery is made to the address specified by the customer.
5.2 Delivery times depend on the shipping provider and are therefore not guaranteed.
5.3 For deliveries outside the EU, additional costs may arise, which are to be borne by the customer.
5.4 Ownership transfers to the customer only after full payment.
6.1 Consumers have a 30-day right of withdrawal.
6.2 Returns must be made within 30 days of registration.
6.3 The refund will be issued after receipt of the goods.
6.4 There is no entitlement to a refund in cases of misuse or damaged products.
7.1 The statutory warranty applies.
7.2 In the event of defects, the product will be replaced or refunded.
7.3 Complaints do not entitle customers to withhold payments.
8.1 Shapetape processes personal data carefully and securely.
8.2 Processing is carried out exclusively for the performance of the agreement.
8.3 The data protection laws (GDPR) apply.
8.4 The data will not be processed outside the Netherlands.
9.1 Liability is limited to direct damages.
9.2 Indirect damages (e.g., lost profits) are excluded.
9.3 Liability only arises after written notification of defects.
9.4 Claims become time-barred after 12 months.

11.1 If Shapetape is unable to fulfill its obligations due to force majeure, Shapetape is entitled to terminate the agreement in whole or in part.
11.2 Such a situation is considered permanent if performance cannot be provided within 14 days.
11.3 Obligations are suspended during force majeure.
12.1 All rights to the products remain with Shapetape.
12.2 Reproduction or use is prohibited without consent.
12.3 Products may not be passed on to third parties.
12.4 Trademark and ownership notices may not be altered.
13.1 If any provision is invalid, the remaining provisions shall remain valid.
13.2 Disputes shall first be resolved amicably.
13.3 Otherwise, the competent court shall decide.
13.4 Dutch law applies exclusively.
13.5 The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
13.6 Shapetape is entitled to amend these terms.
